    I (homeowner) agree to the following rules, regulations, and terms and conditions as set forth by the guidelines and the use/rental/lease for the Boniwood Homeowners Association Recreation center located at 5296 West Boniwood Turn, Clinton, Md.20735. I understand that if I violate any of the terms set forth in the rules and regulations packet that my event can be shut down, my security deposit may be withheld, and I may be subject to additional charges.

    • Who is eligible to use/rent/lease the facility?

      • Any Boniwood Homeowner Association member who is in good financial standing with no outstanding dues/fees/fines/violations.

      • Adult homeowners, age 21 or over, may contract for use of the facility

      • A valid driver’s license, a government issued I.D, and proof of ownership must be presented to be eligible to contract the facility

    • Hours of Operation for Rentals

      • Sunday through Saturday – 7:00 am – 12 midnight

      • Exceptions: Fourth Tuesday of each month (Except August) 7PM – 10PM and the third Saturday in September 7am – 12 midnight

    • Capacity

      • The maximum capacity is 100 people (including any musician’s, deejays, or other performing groups). This limit may not be exceeded at any time.

    • Rules

      • NO ALCOHOLIC BEVERAGE OF ANY KIND SHALL BE CONSUMED ON THE PROPERTY

      • For special events, such as notable celebration of adult birthdays for ages 50, 75, 100, weddings, funeral repasts and anniversaries, the use of complimentary alcoholic beverages (such as champagne, beer, or wine) must be approved in writing by the Board of Directors prior to the event.

      • General public ticket selling events are prohibited. Nor shall the homeowner charge admission, a cover charge, or accept a donation to an open party for admission.

      • For the use of or knowingly to allow his/her/their guest to engage in illegal activity on the premises is prohibited and will carry the consequences of legal prosecution to the full extent of the law.

        PLEASE NOTE: The recreation center is being monitored by surveillance cameras at all times

      • Keys must be returned to the management office, their representative within 24 hours following the scheduled event

      • Activities for minors, pre-teens, or any person(s) under the age of 21 years old, must have a responsible adult present at all times.

      • Any event for ages 13-21 years old is required to hire security offices(s) (minimum 1 officer per 75 people) from a bonafide security business certified to operate in Prince Georges County. Documentation to be provided with final payment.

      • Any event(s) connected with children 1-12 adequate supervision is the responsibility of the parent or guardian and must be enforced while on the premises.

      • All decorations used in the building must be flame proof. Nails, screws, push pins, staples or tape of any kind is not permitted for hanging decorations. Alternations to the facility of any type (structural, electrical, etc. is not permitted.

      • The facility must be glitter, confetti, silly string and any like products/materials free. The actual cost of cleanup will be deducted from the security deposit. If additional charges exceed the security deposit, the difference will be added to the homeowners HOA account.

      • The Association assumes no responsibility for the personal property of the Homeowner (and/or their guests/visitors) and the property will be removed from the premises at the end of the rental period.

      • The rental agreement must be in the possession of the homeowner to whom it was issued and presented to any authorized agent of Boniwood Homeowners Association. The homeowner to whom the rental agreement is issued must be in attendance (on the premise) for the entire event. Rental agreements are non-transferrable.

      • Uses of the facility for consecutive days require the approval from the board of Directors. Community religious activities must be open to all residents, girls and boy scouts, adult social organizational meetings; etc. must be confirmed by the property manager before the request is brought before the board for review

      • No pets or animals are allowing within the facility except for use by seeing impaired or blind
        individuals or use by police under search and seizure laws.

      • Fireworks of any kind in, on, around the common areas, grounds, basketball court, tennis courts, etc. are strictly prohibited.

      • Smoking is not permitted

    • FINANCIAL OBLIGATIONS (deposit, fees, and payments) for use of the facility)

      • The fee for use of the facility is $725.00 per event each day.

      • A deposit in the amount of $200.00 in certified funds (cashier’s check or money order only) must be made to the property manager or Comsource management on the day reservations are made. ( No personal checks will be accepted. Reservations will not be held without a $200.00 deposit.

      • Final payment of $525.00 ($400.00 rental fee plus $125 cleaning fee) must be made seven at least (7) business days before the event is to take place. If payment is not made within seven (7) business days before the event, the reservation may be cancelled and forfeiture of the $200.00.

      • The keys will be released 24 hours before the event. A pre-inspection check-list of property inventory will be conducted and signed by the property manager or authorized agent and the homeowner renting the facility.

      • Following the event, a post inspection of the facility will be conducted with the property manager inventory checklist. A refund of the $200.00 deposit will be made 15 business days following a satisfactory inspection

    • Conditions for Restricting Return of Deposit

      • Any damage or destruction to the building made by a contractor, vendor, or his/hers/their guest/visitors.

      • Any damage or destruction to the kitchen equipment or utilities, including but not limited to items as the stove, refrigerator, garbage disposal, counter tops, cabinets, or any properties within the facility. No person under the age of 18 years old is authorized to operate the stove or any other appliance within the facility.

      • Any damage or destruction of restrooms facilities including, but not limited to the toilet, face
        bowls, mirrors, walls, waste cans, etc...

      • Any unauthorized use or removal of items stored in this facility including but not limited to chairs, tables, trash cans, coolers, banners, dry good, etc...

      • Any damage to the lawn, landscaping, parking lots, basketball court and other amenities that are on the grounds of this facility.

      • Any damage, destruction or removal from the facility of any chairs, tables, and trash cans. All chairs and tables must be stacked in a neat and orderly fashion.

      • Failure to clean the facility and restore it to the condition in which it was delivered.

      • Failure to remove all trash, debris, and decorations after the event.

      • Failure to turn off all light at the end of the event. Any adjustments to the heating or cooling
        system thermostat must be brought to the attention of management. Failure to do so and damage is caused as a result, the homeowner will be charged for any necessary repairs to the unit.

      • Failure to secure the facility after the event

      • Failure to return keys to the facility to management will result in a $200.00 key charge and forfeiture of deposit

      • Any damage to the laminate floors on the upper level. See Floor Care Advisory attached to this document.

      • If there is any damage to the facility noted during the post inspection, the homeowner will
        forfeit the security deposit and may be subject to additional charges for the repair and/or replacement of HOA property. The balance may be added to the HOA homeowners account

        if repairs are more than the security deposit.
